What is happening at the Kamp Armen Armenian orphanage in Tuzla?

The AK Party tries to compensate the misconducts of the single-party mentality which confiscated much of non-Muslim communities' endowments. This can be clearly seen in the case of Tuzla's Kamp Armen Armenian orphanage



The Kamp Armen Armenian orphanage in Tuzla, which belongs to the Gedikpaşa Armenian Protestant Church Foundation, was appropriated by the state during the process that began in 1983. The proceedings for the return of the title deed continued until 1993 and resulted in a decision against the foundation. With the 1936 declaration that was issued during the single-party Republican People's Party (CHP) period, the severity of the "threat" was measured by closely examining Islamic and minority foundations. In 1936, all the Ottoman endowments, including those of minorities, were asked to declare their assets. Since the foundations foresaw what was going to happen to them, they did not include some of their valuable properties in their declarations. The state first suspended the declarations for a while. Then a process of expropriating properties belonging to both Muslim and minority groups began. The declarations issued in 1936 were accepted as endowments and the properties that were not included in the declarations were either returned to their former owners or seized by the Directorate General Foundations or the national estate in cases when the owner could not be found.This fascist implementation was reformed with an amendment made in the Foundations Law by the Justice and Development Party (AK Party), abolishing the practice of expropriation. Moreover, a process was initiated that enabled foundations to reacquire, reclaim and rejuvenate their properties, and which most importantly, returned the seized properties. The CHP brought this revolutionary reform to the Constitutional Court with their current Chairman Kemal Kılıçdaroğlu's signature, on the grounds that the reform "dynamites the grounds of the state." With Law 5737, a total of 353 landed properties have been returned so far. And good will efforts are ongoing to resolve the problems that are faced in the return process. However, the case of the Tuzla Armenian orphanage unfortunately followed quite a different, complicated and negative judicial practice. The former owner, to whom the court returned the property, immediately sold it, and the property has changed hands multiple times, which made its return impossible. In such a case, the fate of the orphanage, which was recorded as the property of a private individual through judicial practices, is subject to long proceedings. But in a process that will be brought before the European Court of Human Rights (ECtHR), the cash price of the property might possibly be received. With the intervention of the government, the demolition process of the orphanage that was initiated upon the demand of the property owner was halted. Now there is no possibility of demolition. Since the very beginning of the incident, the government has taken a close interest in the case. With Prime Minister Ahmet Davutoğlu's order, Istanbul Mayor Kadir Topbaş and AK Party Provincial Chairman Selim Temurci stepped into action. In the most recent phase, foundation representatives and Temurci developed a common strategy after the latest meeting they held on May 14, and the process of returning the orphanage from its current owner to the foundation was planned. Upon Temurci's request, Tuzla Mayor Şadi Yazıcı took over the negotiations that will be held with the property owner. The AK Party not only ended this venomous practice that was imposed by the single-party mindset during the 1930s, but is also still trying to resolve the consequences of a state practice it is completely opposed to with political will and good intentions. The government does not have any political expectations regarding this matter. As a political movement that stands in the right position in the name of ethics and justice, it is concerned with the problems of the entire public to the same degree, and it is trying to resolve the large-scale problems that have accumulated over the course of 80 years.
