The bankruptcy of the Gülen Movement

The judicial officers who are being investigated must be monitored carefully. The thought of being dismissed from their positions might lead them to engage in even more illegal activity



Hanefi Avcı is a former chief of police who garnered the attention of the Turkish public with his successful operations in the past. But what really brought his name into the spotlight was the book he wrote in 2010. Entitled "Haliç'te Yaşayan Simonlar: Dün Devlet Bugün Cemaat" (Devoted Residents of Haliç: Yesterday State, Today Religious Community), the book suggested that the Gülen Movement, led by Fethullah Gülen, which presents itself as a movement of dialogue and peace, had secretly leaked into various state institutions, including the police department and judicial system. As someone familiar with state bureaucracy, intelligence and the police department, Avcı asserted in his book that the Gülen Movement was plotting against certain individuals using its power in the judiciary and had caused the unjust arrests of many people, including several journalists.I remember those days very well. Avcı's book caused a huge debate by the public. But this posed a problem for Avcı, since a de facto empire of fear was prevalent no one could make any explicitly negative comments about the Gülen Movement. Just like the journalist Nedim Şener, Avcı also suffered because of the claims contained in his book. First, media outlets and journalists affiliated with the Gülen Movement, and then members of the judiciary and police officers linked to the Gülen Movement targeted Avcı. As chief of police, Avcı was charged and arrested for aiding a terrorist organization.The public was confused. People did not know what to think for two main reasons. First of all, the person charged for aiding a terrorist organization was a chief of police, which did not sound very reasonable. However, the police uncovered some voice recordings that were hidden in Avcı's house to be used against others. Many allegations were made against Avcı. The justice system took action. Surely a chief of police would not face such severe charges unjustly, or so people thought.Due to the book he completed in August 2010, Avcı was imprisoned in September of the same year. The facts concerning Avcı's arrest and the evidence collected against him were unveiled afterward. It was found that the voice recordings seized in Avcı's house were actually placed there by the police who then raided his house. In other words, evidence was fabricated against him. Avcı, who was imprisoned by the police and judges affiliated with the Gülen Movement, was acquitted in June 2014 after the Constitutional Court found a violation of his rights. All allegations against him were dismissed.Avcı was also active in prison. When I met him in prison for an interview, I saw the notes he took on small pieces of paper and the research he conducted despite the prison conditions. Avcı wrote a new book while in prison titled "The Bankruptcy of the Movement." According to Avcı, the Gülen Movement went bankrupt after all of their misdeeds were revealed following the Dec. 17 operation. According to him: "The movement was going to take over the responsibility with its collective structure since it carried out all the misdeeds with its collective structure."An incident that verified the arguments in the book took place a day after the book was released. Two judges made the unlawful decision to acquit all the police officers linked with the movement who were arrested on charges of illegally wiretapping thousands of citizens. Other judicial bodies and the Supreme Board of Judges and Prosecutors (HSYK) prevented this and the decision was declared null and void.In my opinion, these two judges were attempting to blatantly violate the law due to the works initiated by the HSYK concerning the judicial leakage of the Gülen Movement. The HSYK examined many proceedings that were handled in the past. The question is did judges and prosecutors protect the interests of the Gülen Movement during the disputed proceedings, or did they take fair decisions? If the examination reveals that some judges and prosecutors used their judicial authority in order to support and protect the interests of Gülen Movement, they will be discharged from their posts. Reportedly, the examination involves more than one hundred judges and prosecutors. The judicial officers who are being investigated must be monitored carefully.
