Lawyer points out irregularities in Ergenekon case


Turgut Kazan, a lawyer for the Republican People's Party (CHP), has been added to the Ergenekon case by Prosecutor Zekeriya Öz, after giving a report to Peoples' Democratic Party (HDP) Co-Chair Selahattin Demirtaş, Nationalist Movement Party (MHP) Chairman Devlet Bahçeli and former CHP leader Deniz Baykal about what happened in Erzincan and Erzurum. While bearing his testimony on the grounds that he was a member of the Ergenekon organization on Jan. 28, Kazan said that he was talking about what had been going on in Erzincan and Erzurum at that time, defending İlhan Cihaner, saying: "On the same day, I had a meeting with Demirtaş, Bahçeli and Baykal and presented a report to them. I told them how the special courts conducted the case in an immoral manner. Of course, [Gülenist] prosecutors froze off this, particularly Zekeriya Öz," daily Cumhuriyet reported. Kazan also demanded that the Prosecutor's Office of Terror and Organized Crimes launch an investigation into Öz, then department chief of the Istanbul Organized Crimes Office; Nazmi Ardıç and related judges; prosecutors and police in his testimony that he gave at the Istanbul Palace of Justice."I am a lawyer. I have a responsibility to secrecy, legally. However, those prosecutors taped my phone calls with my client and put them into the file. Additionally, they eavesdropped and shadowed me for a year and they kept the records to themselves and did not put it into the file," Kazan said before adding that the prosecutors, which he labeled Gülenists, violated laws such as "privacy of communication," "privacy of private life," "forming and managing a crime syndicate," and "recording private data," by keeping data belonging to him for use against him. He additionally demanded to be sued in a criminal case for speaking out against the "immoral issues" carried out during the case. In another incident concerning Öz, a criminal case has been filed for threatening and insulting the then prime minister, Recep Tayyip Erdoğan, on his Twitter account regarding the Dec. 17 and Dec. 25 operations, allegedly orchestrated by the Gülen Movement in an attempt to topple the government. Öz was later accused of being impartial while carrying out his duty and the Supreme Board of Judges and Prosecutors (HSYK) launched an investigation into him for losing his objectivity as a prosecutor when he tweeted critical comments about Erdoğan.The HSYK report from the investigation said that Öz threatened police officers on Dec. 18, a day after he imitated the operation that is perceived as a major part of the Gülen Movement's alleged attempt to overthrow the elected government. It was also claimed that Öz also tried to influence some of the Fatih Municipality staff. The report added that he was involved in a scandal about taking an extravagant vacation to Dubai that was financially supported by businessman Ali Ağaoğlu. He is accused of receiving $20,259 for a luxurious vacation. Öz also faced a lawsuit for insulting and threatening then Prime Minister Erdoğan on social media, but he did not appear at the hearing.
