An individual application was made to the Constitutional Court yesterday charging that the arrest of Republican People's Party (CHP) Deputy Enis Berberoğlu, who was sentenced to 25 years in prison for his role in leaking secret documents during the National Intelligence Organization (MİT) trucks case, was unlawful.

Speaking to reporters following the application, Berberoğlu's lawyer, Murat Ergün, said that this arrest shows that internal authorities are exhausted.

"We applied to the Constitutional Court since the arrest was carried out. We said the arrest is a serious violation of security, freedom and designation laws," Ergün said.

He added that there are hopeful of the result since up until now the Constitutional Court has always sided with the rule of law and freedom.

Earlier in the morning, CHP Chairman Kemal Kılıçdaroğlu said Berberoğlu's lawyers would apply to the Constitutional Court and he is hoping that justice will be served.

Following the prison sentence on espionage charges, Kılıçdaroğlu launched a 400-kilometer march from Ankara to Istanbul last week in protest of the decision. He is joined by several thousand protesters and began the "Justice March" from Güvenpark at Kızılay Square in central Ankara.

Elsewhere, permission has been given to Berberoğlu for him to attend the funeral of his father-in-law.

Berberoğlu was accused of supplying confidential information regarding the country's intelligence service to two journalists, Can Dündar and Erdem Gül, in a controversial case.

Istanbul's 14th Superior Penal Court sentenced Berberoğlu to 25 years in jail for releasing secret documents with the purpose of political or military espionage. Berberoğlu was arrested in the courthouse after the hearing. He will remain incarcerated while waiting for the appeal process to conclude.
