FETÖ members pushed prosecutor to include former TSK chief into 'baseless' indictment
A prosecutor who was interrogated as a witness in the investigation into the Gülenist Terror Organization (FETÖ), which orchestrated a coup attempt on July 15, said he was ordered by FETÖ members to include former army chief Yaşar Büyükanıt into the criminal charge sheet of a 2005 terror attack in the southeast.
Ferhat Sarıkaya is a prosecutor at the Public Prosecutor's Office in Ankara and prepared a file that accused Büyükanıt of forming a gang when he was a prosecutor in eastern Van province. He said FETÖ judges and police chiefs helped him to include Büyükanıt into the file when he was the Commander of Land Forces and expected to become Chief of General Staff.
He said that İlhan Kaya, an arrested FETÖ-linked member of the Supreme Court of Appeals and chief of the 3rd Heavy Penal Court in Van at the time, had steered him about the case after Sarıkaya assumed it. "He wanted me to focus on Yaşar Büyükanıt especially. It was almost certain that he would be the Chief of General Staff. He wanted me to add Büyükanıt into the incident in Şemdinli," he said, adding that Kaya wanted him to do this with the pretext of preventing Büyükanıt from carrying out a military coup.
"When the chief of the court wanted to see the criminal charge draft, Kaya worked on it. He also added several paragraphs in which heavy accusations were presented. I told him that those should be taken away from the text but he told me that nothing will happen. I stood idle for all of these in order to prevent a military coup. He wanted his court to be authorized with this criminal charge and accomplished this as well. He accepted the document in two days."
He also said the authorized inspectors regarding the case, İbrahim Kir and Cevat Gül were also members of FETÖ in 2006 and they told him that there is nothing to be concerned about.
Furthermore, Sarıkaya also stated that Kaya had once encouraged him in the case by saying that FETÖ leader Fethullah Gülen praised him, with the U.S.-based imam saying, "There is such a hero, he and his family will be looked after for his whole life as my last will."
On Nov. 9 2005, a bookstore was bombed in the Şemdinli district of the southeastern Hakkari province. Regarding the incident, Sarıkaya prepared a criminal charge, in which two sergeants and a confessed PKK member were suspects together with Büyükanıt, which said, "I know he is a good boy" about one of the sergeants. Later on, both sergeants and the PKK member were sentenced to nearly 40 years in prison.
